1. Agreement
These terms are an agreement between you and Bixobook (“Bixobook”, “we”, “us”). They apply when you use the Bixobook app, the shopkeeper panel, the add-on store, this website and the shop websites we host (the “Services”).
By creating an account or using the Services, you accept these terms and our privacy policy. If you use Bixobook for a business, you confirm that you may accept these terms for that business, and “you” includes the business. If you do not agree, do not use the Services.
These terms are an electronic record under the Information Technology Act, 2000, and do not need a physical or digital signature.
2. The Services
Bixobook is software for Indian shops and small businesses. It provides GST and non-GST billing and POS, khata (customer and supplier balances), items and stock, purchases, expenses and cashbook, reports, staff roles, a shop website and online store, WhatsApp and SMS messaging, and AI writing and insight tools. Features and limits depend on your plan, as shown on the billing page in the app.
3. Your account
- You must be at least 18 years old and able to enter a binding contract under Indian law.
- Give correct details, including your business name, address and GSTIN, and keep them up to date.
- You sign in with your mobile number and a one-time code. Keep your phone and codes secure. You are responsible for everything done in your account, including by staff you invite. Remove staff access when someone leaves.
- Tell us at once at support@bixobook.in if you think someone has used your account without permission.
4. Plans, payments and taxes
- The Free plan costs nothing and has the limits shown in the app. Paid plans (currently Pro, Business and Enterprise) are billed monthly or yearly at the prices shown in the app when you subscribe. Prices do not include GST, which is added to every invoice.
- You can pay by Razorpay auto-pay (UPI, card or other methods Razorpay supports), which renews automatically at the end of each period until you cancel, or pay for one period from your Bixobook wallet.
- If a renewal payment fails, your account may enter a short grace period. If payment still is not made, the account moves to the Free plan limits. Your data stays safe; features above the Free plan stop working until you pay.
- Upgrades take effect straight away. Cancelling or downgrading takes effect at the end of the period you have paid for, and you keep paid features until then.
- We may change plan prices or limits. We will give at least 30 days’ notice in the app or by email or SMS. New prices apply from your next renewal after the notice.
- Refunds are covered by our refund and cancellation policy.
5. Bixobook wallet and add-ons
- The Bixobook wallet is a prepaid balance you can use only to pay for Bixobook plans and add-ons. It is not a bank account or payment instrument. It earns no interest, cannot be transferred to another business, and cannot be used to pay anyone else.
- Add-ons, such as website designs, WhatsApp message templates, limit packs and extra features, are digital items. They are activated on your account as soon as you buy them. Some last for the period shown on the item (for example 30 days or 1 year); others are yours for as long as your account is open.
- A website design or template you buy gives your business a licence to use it in Bixobook. It does not transfer ownership, and you may not resell or copy it outside Bixobook.
6. Your data
Everything you enter, such as items, bills, customers, khata and reports (“Your Data”), belongs to you. You give us permission to store, process, back up and display Your Data only to provide and improve the Services, as described in the privacy policy.
You can export Your Data from the app at any time. We take regular backups, but you should also keep your own copies of records you are legally required to keep.
When you enter personal data about other people, such as your customers and suppliers, you are responsible for collecting it lawfully, with their consent where needed, and for answering their requests about it. We process it on your behalf.
7. Shop websites and online orders
When you turn on your shop website or online store, you are the seller. The contract for any sale is between you and your customer. Bixobook only provides the technology and is not a party to the sale, an agent of either side, or a marketplace operator.
You are responsible for:
- the items you list, their descriptions, photos, prices and taxes, and having the right to sell them;
- showing your correct name, address, contact details and GSTIN, and your own return, refund, cancellation and delivery terms, as required by the Consumer Protection (E-Commerce) Rules, 2020;
- packing, delivery, cash on delivery collection, returns, refunds and customer complaints;
- reviews you publish and how you respond to them.
Online payments for your orders go through your own Razorpay account under Razorpay’s terms. Bixobook does not hold or settle the money from your sales. You must not sell anything the law prohibits or restricts, or anything banned by Razorpay or WhatsApp.
We may hide a listing or turn off a shop website that breaks these terms or the law, or after a valid complaint or order from an authority.
8. WhatsApp, SMS and email messages
Messages you send through Bixobook, such as reminders, bills, order updates and campaigns, are sent in your business’s name. Send them only to people who have agreed to hear from you. Follow the WhatsApp Business policies, TRAI’s rules on commercial communication (including DLT registration for SMS), and anti-spam law. We may limit or stop messaging from an account that receives complaints or is blocked by a messaging provider.
9. GST and your own compliance
Bixobook calculates GST, numbers your invoices and prepares summaries such as GSTR-1 and a 3B estimate to help you. These are tools, not tax or legal advice. You are responsible for checking your invoices and returns, filing them on time, and meeting your obligations under GST, income tax and other laws. Speak to your accountant or tax adviser before filing.
10. Acceptable use
You must not use the Services to:
- break any law, or issue fake or misleading invoices, or evade tax;
- sell or promote illegal, counterfeit, stolen or harmful goods or services;
- send spam, or messages that are abusive, defamatory, obscene, hateful or misleading;
- upload content you do not have the right to use, or that infringes someone else’s rights;
- upload viruses or harmful code, or try to break into, overload, scrape or reverse engineer the Services, or get around plan limits;
- misuse sign-in codes, free plans, coupons or referrals, for example by creating many accounts;
- pretend to be someone else, or resell the Services without our written permission.
This is in addition to the content rules in the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which also apply.
11. Third-party services
Some features rely on other companies, such as Razorpay, WhatsApp, SMS and email providers, Google and our AI provider. Your use of those features may also be subject to their terms. We are not responsible for their services, outages or decisions, such as a payment being held or a WhatsApp number being blocked.
12. Our intellectual property
The Services, including the software, designs, logos, text and the Bixobook name, belong to Bixobook or its licensors. We give you a limited, non-exclusive, non-transferable right to use them for your business while your account is open and you follow these terms. If you send us feedback or ideas, we may use them without paying you.
13. Availability and changes
We work to keep the Services running and your data safe, but we do not promise they will be available all the time or free of errors. We may need to pause them for maintenance or upgrades, and we will try to warn you in advance. We may add, change or remove features. If we remove a major paid feature during a period you have paid for, we will offer a fair refund for the unused part.
14. Suspension and closing an account
You can stop using the Services at any time, and cancel a paid plan by choosing the Free plan under Settings → Plan & billing. To close your account and delete your data, write to support@bixobook.in.
We may suspend or close an account, with notice where reasonable, if you break these terms or the law, if a payment is not made, if we must for legal or security reasons, or if a free account has not been used for 12 months. Before we close an account we will, where we can, give you the chance to export Your Data. Sections that by their nature should continue, such as liability, indemnity and disputes, continue after closure.
15. Disclaimer
Except as these terms say, the Services are provided “as is” and “as available”. To the extent the law allows, we disclaim all other warranties, express or implied, including fitness for a particular purpose and that reports, tax figures or AI results will be complete or accurate. Check important figures before relying on them.
16. Limitation of liability
To the extent the law allows, Bixobook is not liable for indirect, incidental or consequential loss, such as lost profits, sales, data or goodwill. Our total liability for any claim about the Services is limited to the amount you paid us in the 12 months before the claim, or ₹1,000 if you paid nothing. These limits do not apply where the law does not allow them, such as for fraud.
17. Indemnity
You will compensate Bixobook for any loss, claim or penalty, including reasonable legal costs, arising from your breach of these terms or the law, Your Data, the goods or services you sell, or the messages you send.
18. Governing law and disputes
These terms are governed by the laws of India.
If you have a dispute, please first contact us at support@bixobook.in or our Grievance Officer. We will try in good faith to resolve it within 30 days. If it cannot be resolved, the courts having jurisdiction over our registered office have exclusive jurisdiction, without affecting any right you have as a consumer to approach a consumer commission.
19. General
- We may update these terms. We will post the new version here with a new date and tell you of significant changes in the app or by email or SMS. If you keep using the Services after a change takes effect, you accept the new terms.
- If any part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these terms without our consent. We may transfer ours as part of a merger, sale or reorganisation.
- We are not responsible for delays caused by events outside our reasonable control, such as network or power failures, natural disasters or government action.
- These terms, with the policies they link to, are the whole agreement between you and us about the Services.
20. Contact and grievances
Questions or complaints: support@bixobook.in. Our Grievance Officer can be reached at support@bixobook.in. Complaints are acknowledged within 48 hours and resolved within one month. See the contact page for all our details.
